What Is a Lemon?

In general, lemons are cars, suvs, motorcycles or trucks that are under warranty and have serious issues despite several repair attempts.

Does The California Lemon Law Apply To Me?

California Lemon Law usually, but not always, applies to new, used, or leased, automobiles (including motorcycles, boats, and RVs) that are under warranty when:

  • Repairing at least two issues that would likely cause serious bodily injury or death
  • Repairing the same nonconforming issue at least four times
  • Repairs have caused your car to be out of service at least 30 calendar days since being delivered

The manufacturer will pay our fees and court’s fees if we are successful on your claim.  Your settlement is yours to keep.

What is a “reasonable” number of tries to repair?

It depends on these important factors:

  • Is the problem serious enough to likely cause bodily injury or death if you drive it?
  • How long has your car been in the shop for warranty issues or repairs?

Minor defects aren’t usually serious enough to make your car a lemon, but your special circumstances could make a significant difference.  Call our Huntington Beach lemon law group with your questions—we are ready to talk to you!

What Happens If The Manufacturer Wants To Go To Trial?

On the rare occasion that we need to go to trial, we can get fees in addition to your losses. This instance is the only time we would receive a portion of the recovery costs in addition to your fees, which the manufacturer also pays.

My Vehicle Qualifies, What are my options?

Your attorney will consult with you before making any settlement decision. The options that you and your attorney will generally be discussed are:

  • Replacement – The manufacturer provides you the same terms of your prior contract on your choice of new vehicle
  • Refund – The manufacturer pays off the balance of your loan and refunds your money
  • Settlement – You receive cash for the defect and keep the vehicle at a diminished value
  • Incidentals – The manufacturer will cover your costs for repair, towing, and rental cars

Give the Huntington Beach Lemon Law Attorneys A call (714) 644-9369 We will go over all of your options, consultations are completely FREE.

Who Pays The Attorney Fees?

The Manufacturer always pays all attorney fees. You will never have to pay any part of the attorney fees. The entire process is FREE to you.

What Will the Settlement Amount Be?

You may entitled to a replacement car, for the manufacturer to buy it back from you (less the amount of your use), or other damages. This depends on the details of your claim. We are experienced in the law and with working through claims with the manufacturers.  Let us help you recover as much as much as possible!

How Long Will It Take to Settle?

The time it would take to reach a settlement under lemon law depends on several factors. What types of issues does your car have? How many attempts have you made to pair it? What is the car’s history? Who is the manufacturer? What was the statues of your claim when you contacted us? Which specific laws apply to your situation?

Our goal is to reach a settlement on your claim as soon as possible. We have experience working the legal departments of manufacturers, which helps us work through your claim efficiently.

Do I Really Need a Lemon Law Attorney to File My Claim?

You have every right to file a claim yourself, without a lemon law attorney. However, you don’t have all the information you need to recover the entire compensation amount you are entitled to. The manufacturer knows you are not trained in matters of the law, which leaves you vulnerable. Our experience allows us to prepare your claim, file, and handle the manufacturers for you, which sets you up for a successful claim. Remember that you don’t pay us a dime! If we are successful, the manufacturer covers our fees. What do you have to lose?

Would the Law Still Apply If I Bought My Car in Another State?

You may be covered by federal lemon law, or a number of different laws, no matter where you currently live or where you bought your car. We will determine which laws apply to your claim when we have the details of your situation. Call us today!
